01 Overview

The Melanin Beauty operates as an online retailer and distributor of beauty products created and owned by Black entrepreneurs.

These Terms apply to all users of the Site, including browsers, vendors, customers and merchants.

02 Online Store Terms

By agreeing to these Terms, you confirm that:

• You are at least the age of majority in your province, territory or jurisdiction of residence.
• You will not use our products or Services for any illegal or unauthorized purpose.
• You will not violate any applicable laws through your use of our Site, Services or products.

03 Product Information

We strive to ensure that product descriptions, images, availability and pricing are accurate. However, we do not guarantee that all information is complete or error-free.

We reserve the right to correct errors, inaccuracies or omissions and to change or update information as permitted by applicable law.

Product colours and appearance may vary depending on your screen, lighting and device settings.

04 Pricing and Payment

Unless otherwise indicated, prices are displayed in Canadian dollars (CAD). Applicable taxes, shipping charges, duties and other fees may be added during checkout.

We accept payments through secure third-party payment processors. By submitting payment information, you confirm that you are authorized to use the selected payment method.

05 Order Processing

We generally process orders Monday through Friday, excluding statutory holidays. Processing times may vary depending on product availability, order volume and other circumstances.

You will receive a confirmation after your order is placed and shipping information when it becomes available. An order confirmation does not necessarily constitute our acceptance of an order.

We reserve the right, as permitted by law, to refuse or cancel an order, limit quantities or request additional information before processing an order. If we cancel a paid order, the applicable payment will be refunded.

06 Shipping

We currently ship across Canada and to selected international destinations. Available shipping options, estimated delivery times and rates are displayed during checkout.

Delivery estimates are not guarantees. After an order has been transferred to a courier, delivery may be affected by courier operations, weather, customs or other circumstances outside our reasonable control.

International customers may be responsible for applicable duties, taxes, customs fees or import charges unless otherwise stated during checkout.

07 Return and Exchange Policy

Except where a return, refund, replacement or cancellation is required by applicable law, all sales are final.

If an item arrives damaged, defective or incorrect, please contact us within three days after delivery at customerservice@themelaninbeauty.ca .

Include your order number, a description of the issue and clear photographs of the product and shipping package.

08 Prohibited Uses

You may not use this Site, its Services or its content:

• For an unlawful or fraudulent purpose.
• To solicit others to perform or participate in unlawful acts.
• To violate applicable international, federal, provincial, territorial or local laws.

• To upload, transmit or distribute viruses, malicious code or other harmful technology.
• To interfere with the security, functionality or proper operation of the Site or Services.
• To collect or track the personal information of others unlawfully.

We reserve the right to suspend or terminate access to the Services for violations of these Terms, subject to applicable law.

Content on this website—including text, images, graphics, logos, designs, videos and original product listings—is owned by The Melanin Beauty, licensed to us or used with permission from our brand partners.

You may not reproduce, modify, distribute, publish, sell or commercially exploit protected content without prior written permission from the applicable rights holder.

10 Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Site, Services and products are provided on an “as is” and “as available” basis.

We do not warrant that access to the Site or Services will always be uninterrupted, timely, secure or error-free.

Nothing in these Terms excludes warranties, conditions, guarantees or consumer rights that cannot lawfully be excluded or limited.

11 Limitation of Liability

To the maximum extent permitted by applicable law, The Melanin Beauty and its directors, officers, employees, affiliates, agents, contractors and service providers will not be liable for indirect, incidental, special, consequential or punitive damages resulting from your use of the Site or Services.

Where liability may lawfully be limited, our aggregate liability relating to a purchased product will not exceed the amount paid for that product.

Nothing in these Terms limits or excludes liability or consumer remedies that cannot lawfully be limited or excluded.

12 Changes to These Terms

We may update, change or replace portions of these Terms from time to time, including to reflect changes to our practices, Services or legal obligations.

Updated Terms will be posted on this page with a revised effective date. Your continued use of the Site after an update constitutes acceptance of the revised Terms to the extent permitted by applicable law.

13 Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the applicable federal laws of Canada, without limiting any mandatory consumer protection rights that may apply to you.
